MONTANA NOTARY BONDS

Notaries are required to maintain surety bonds for the State of Montana. This is because they handle important documents for citizens and a mistake, whether committed purposely or by accident, can have a disastrous financial consequence for people they are notarizing for. A surety bond protects the public from these mistakes for the policy amount of the bond.

A
$10,000 notary surety bond is required for all applicants in the state of Montana (new and renewal) applying for a notary public commission. This bond is an insurance agreement making the surety liable for up to $10,000 in damages for failure of the notary applicant to perform his or her duties that results in damage to the public.

The exact wording of Montana Notary Law is as follows:

1-5-405. Bond and commission -- dates -- fees and documents.

Each notary public shall submit an application, a signed oath of office, and an official bond in the amount of $10,000 for each 4-year term of office. The application and bond must be approved by the secretary of state. Upon the approval of the application and the bond, the payment of fees, and the filing in the office of the secretary of state of the official oath of the notary public, the secretary of state may issue a commission.

The effective date of the surety bond and the notary commission must be the same.

All required fees and required and properly completed documents must be submitted to the office of the secretary of state within 30 days before or within 30 days after the effective date of the surety bond.
